Many facilities do not allow stag and does.  This is a list of places that still allow these events.  As well, we have listed some of their rules in regards to gaming or gambling and whether they allow you to bring in your own liquor license and sales.

 

Before reviewing the list of halls that allow stag and does, I want to give you a general perspective on gambling (now called gaming in Ontario).  Below this paragraph is the actual municipal governments "legal take" on different forms of gambling.  Please feel free to contact your own municipality on their stance, but, you can trust that it will be quite similar to what is listed below. Now the "perspective"...

I do not expect to be pulled over and ticketed for driving 105km/hr on the 401.  However, it is absolutely against the law and no one in an authoritative position should or would tell you that it is okay (call the police and ask them if you are going to get pulled over for going 53km/hr in a 50km zone, after they answer you, ask them if you can get it in writing). This article http://www.drivers.com/article/149/  proves that you can follow the law and drive the speed limit and still be charged.  Better yet this article explains the "perspective" of the gambling laws very nicely.  The "Moral Order", everyone knows that you drive 110km/hr and it is okay because everyone does it yet it is illegal.  This is where you need to put in your own thoughts about gaming at your event and figure out how far you are going to go to raise money.  Clearly, the rules below will show you that you pretty much cannot do anything at all...no draws...no 50/50 no card games...no door prizes.  I challenge you to find a bar in this province that is not running a football pool, golf tourney or other gaming side bet. Yet, every bit of it is completely illegal. This "perspective" is not to persuade you into having an event with gaming, it is to provide you with the facts and views of both sides.  It is sad that it has to be said, but...In no way does this article condone any form of illegal gaming and you should consult your local municipality and follow their directions. 

The following was taken from guelph.ca and reflects the general rules across Ontario. Please do not consider this to be the facts for your specific city (or an up to date version) but view it as a guideline.

 

Poker Parlours / Poker Halls / Poker Nights are Illegal!

Whether your purpose is innocent fun, fundraising, or a Stag and Doe for an upcoming wedding, the Criminal Code of Canada prohibits Gaming, Gambling or Betting.

 

The Criminal Code of Canada defines poker parlours, halls, events, nights under carrying on a "common gaming house".

 

This means a place where persons resort to playing games for profit or gain and in which:

bulletall or any portion of the bets or proceeds from a game is paid, directly or indirectly, to the keeper of the place,
bulletwhere, directly or indirectly, a fee is charged to or paid by the players for the privilege of playing or participating in a game, and
bulletwhere the chances of winning are not equally favourable to all persons who play the game, including the person, if any, who conducts the game;

Everyone who keeps a common gaming house or common betting house is liable upon conviction to fines and/or imprisonment.

 

Everyone who is found in a common gaming house, or every owner who permits the use of their premises for a common gaming house is also liable upon conviction to fines and/or imprisonment.

 

The Police and the Province of Ontario may seize all property related to a common gaming house, and such property shall be forfeit.

 

In short, it’s against the law, and it’s just not worth it.

 

 

10. We are organizing a fundraiser. What sort of fundraising games can we have at the event? 

 

This is a very common question, especially in the summer time when friends and family begin organizing Stag and Does or Engagement parties to raise money for the Bride and Groom.

In addition, we also receive many inquiries from business owners, sports clubs and student bodies looking to raise money through raffles, 50/50 draws and black jack or poker nights.

Gaming regulations in Ontario define a Lottery Scheme as having three main elements:

bulletThere is a fee to participate in the event.
bulletThere is a cash prize or item of monetary value up for grabs.
bulletThere is a random chance of winning.

The following are examples of Lottery Schemes:

bulletRaffles (includes cash raffles, merchandise raffles, 50/50 draws, etc.)
bulletBingos;
bulletBreak Open tickets or Nevada tickets;
bulletBazaars (where bingos, raffles, or other games or chance are involved)
bulletWheels of Fortune (includes Crown and Anchor, Spin & Win, or Money Wheels)
bulletSocial Gaming Events (table games held in conjunction with a social event) 

The Criminal Code of Canada also prohibits Lotteries or Games of Chance without first obtaining a Lottery Licence for the event from the Alcohol and Gaming Commission of Ontario or from the presiding municipality, in this case, the City of Guelph.

In addition;

bulletevery one who makes or prints lots, cards or tickets, sells or exchanges lots, cards or tickets, or conducts or manages a contrivance or operation of a lottery scheme for disposing of any property by lots, cards, tickets or any mode of chance whatsoever; or
bulletdisposes of any goods, wares or merchandise by any game of chance or any game of mixed chance and skill in which the contestant or competitor pays money or other valuable consideration;

is liable upon conviction to fines and/or imprisonment.

Lottery Licence eligibility is determined by the AGCO, however generally speaking only Charitable, Non-profit Organizations are permitted to obtain a licence and conduct a lottery event.


11. What are some fundraising options that do not require licensing? 

 

This is very difficult to address.  Some games of skill may still be illegal, as it is nearly impossible to completely eliminate the element of chance from any game and have the outcome decided by skill alone.

 

Any element of chance, regardless of how small, still makes it a game of mixed chance and skill, even if the element of skill greatly outweighs the element of chance.  In some cases, a “predominance” test has been used by the courts to determine if the outcome is dependant on skill or a mix of skill and chance.


For Example: The outcome in a game of cards may be determined by skill, but the cards that are dealt depend solely on chance.  Therefore the game is predominantly based on chance.

The outcome of a game of golf is greatly determined by skill, but the players can not control elements such as wind, ground conditions, or moisture which can all effect to motion of the ball and lend some elements of the game to chance. However, in this case, the game is predominantly based on skill.

There is still a question of liability where an entry fee is required in order to participate in the game where stakes are still involved. Where a person conducts an event by which anyone may enter the event upon payment of a sum of money, for the opportunity to win an item of monetary value, or sum of money, may still constitute a lottery.

 

We suggest that you contact a lawyer or the Alcohol and Gaming Commission of Ontario to determine if your proposed fundraising ideas are legal.

 

Although the City of Guelph can not make recommendations, or accept responsibility for your event, the best advice is to be creative with your fundraising ideas. Games such as Putting Greens, Goalie Challenges, Balloon Darts, Coin Tosses, and Dunk Tanks would be least likely to cause controversy or attract attention from the authorities.

 

 

 It is funny that the final paragraph from the city is almost a statement suggesting that you can still do something illegal but try to disguise it so that it is harder for us to persecute.
